This article is aimed at identifying the issues and practical difficulties, which have arisen in the Italian courts with regard to divorce proceedings involving the application of EU Regulations on family law. It is based on the analysis carried out on the Italian case law since Brussel IIa and Rome III Regulations came into force in Italy. Furthermore, the case law regarding the application of the Maintenance Regulation is taken in to consideration in order to examine the interplay between Brussel IIa with the Maintenance Regulations. Some selected decisions of other EU States are quoted for a comparative perspective with regard to issues arising in the Italian case law.
