Seven years since the establishment of the national DNA database, and in light of some recent judicial cases, the article deals with the main issues regarding the use of the genetic evidence within the Italian criminal proceedings. Particular attention is paid to the legal treatment of the contaminated material, to some distortions within the forensic practice and to the nature of circumstantial evidence of the results of the genetic analysis.
