I nomophylakes tra utopia e realtà istituzionale delle città greche

The aim of the essay is to examine the nature, and objectives, of Plato’s project of the Laws from the viewpoint of a comparison between the role assigned to the nomophylakes in the city of Magnesia and the functions of the «guardians of the laws» as attested in a number of Classical and Hellenistic poleis by some passages in Aristotle’s Politics and a relatively large body of inscriptions. The case of the nomophylakes in the regime of Demetrius of Phalerum is also considered. From such comparative analysis, it is possible to conclude that Plato’s nomophylakes primarily belong to the «utopic» dimension of the project of the «second city».

Il saggio si propone di esaminare la natura, e gli obiettivi, del progetto platonico delle Leggi nella prospettiva del confronto tra il ruolo assegnato ai nomophylakes nella città di Magnesia e le funzioni dei «custodi delle leggi» nelle città greche tra l’età classica e quella ellenistica quali ci sono attestate da una serie di passi della Politica di Aristotele e dalla relativamente ricca documentazione epigrafica. Si prenderà infine in esame il caso dei nomophylakes riconducibili al governo di Demetrio Falereo ad Atene. Il confronto tra le fonti metterà in luce come i nomophylakes platonici appartengono propriamente alla dimensione «utopica» del progetto della seconda città.
