The problems of real property today are the determination to whom a certain entitlement must be assigned, and what type of entitlement this should be. The classical legal terminology does not have names for all the entitlments created by environmental regulations. Thus, for the first time in legal history lawyers face difficoluties in accomadating public and private interest in land. References to the opposition between public and private property is not accurate and is not helpful.
