The essay analyzes, from a constitutional point of view, the position held by Life Imprisonment within the Statute of the International Criminal Court, discussing also the influence in this regard by the (European and American) law traditions. If it is due to the first one the approval of a Statute both Death Penalty Free and Life Imprisonment Without Parole Free, instead depending on the second one the particular and problematic role paid to the issue of the role of victims of crime, and especially of their relatives, also in reference to the review of Life Imprisonment. After spending some considerations on the case law of the Strasbourg Court regarding Life Imprisonmnent and on the current way of being of European criminal law, the essay ends with few reflections on the complex issue of the functions of the penalties in view of international criminal justice.

Abstract
