Per una rilettura costituzionalmente coerente delle azioni di rivalsa dell’Inail

Moving from the traditional opinion of recourse action as original and autonomous right of INAIL, the Author investigates the actual theorical structure of this autonomy and the related distinction between the special action of art. 11 T.U. and the subrogation action of art. 1916 c.c. To overcome the many inconsistencies of the traditional thesis the Author proposes a different interpretation of the recourse action which, in consistency with the social security protection function, is grounded on the need to ensure additional resources for the financing of the insurance guarantee. In this perspective the distinction between the recourse action and the subrogation action is revised consistently with the overcoming of the classic rule of exemption of employer from tort law.

Muovendo dalla tradizionale concezione del regresso come diritto originario ed autonomo dell’INAIL, l’Autore indaga sull’effettivo fondamento di tale autonomia e sulla conseguente distinzione tra la speciale azione dell’art. 11 e la comune azione di surrogazione di cui all’art. 1916 c.c. Al fine di superare le molte incongruenze presenti nelle tesi tradizionali si propone così una diversa lettura del fondamento del regresso che, coerentemente alla funzione previdenziale della tutela assicurativa, viene individuato nella esigenza di garantire ulteriori risorse per il finanziamento della garanzia assicurativa. Alla luce di questa ricostruzione dell’autonomia del regresso viene quindi sottoposta a rivisitazione la sua distinzione rispetto alla surroga che nel superamento della regola dell’esonero trova una ulteriore conferma.
