La sicurezza del lavoro nel sistema degli appalti

The paper focuses on the regulatory framework concerning health and safety at work where several undertakings share the same work place, and, in a wider view, interact through the supply chain. In the first part the A. resumes the different recent provisions defining the focal company obligations, in the light of the general principles and of the regulatory framework laid down by the Delegated Decree April 9, 2008, no. 81. Then, the A. analyses the measures to ensure the performance and competences of the contractors as well as the duties of information, cooperation and coordination of all the employers and contractors involved in the supply chain. Finally, the essay examines how the responsibilities of each undertaking shall or shall not discharge the responsibilities of the focal company, when and under which conditions the responsibilities of each employer involved in the supply chain shall be excluded or limited.

Il saggio analizza le disposizioni riguardanti le misure di tutela della salute e sicurezza del lavoro in caso di appalto di lavoro e, più in generale, lungo tutta la filiera produttiva. Nella prima parte del saggio l’a. ricostruisce le diverse recenti disposizioni riguardanti gli obblighi del committente alla luce dei principi e del quadro normativo generali delineati dal d.lgs. 9 aprile 2008, n. 81. Successivamente, l’a. analizza le disposizioni riguardanti l’idoneità tecnico professionale delle imprese appaltatrici e gli obblighi di informazione, cooperazione e coordinamento di tutti i soggetti coinvolti nella filiera produttiva. Il lavoro approfondisce il tema delle responsabilità dei diversi imprenditori coinvolti nell’attività produttiva e le condizioni alle quali tali responsabilità possono essere escluse o limitate.
