Taking as its starting points two questionable judgments of the Constitu-tional Court (nn. 296-297/2012), the essay investigates the provision of some social and health services to the disabled and the elderly. These ser-vices are not charge-free; therefore inequalities may arise with regard to access and enjoyment of them. Due to inconsistencies in statute and case-law, a new regulation is required to ensure that the burden of non-self-sufficiency is not left on the shoulders of disadvantaged families, but is shared among all the citizens, through general taxation.
