L'ECONOMIA DELLA PROMESSA NELLO SVOLGIMENTO DELLE OBBLIGAZIONI IN DIRITTO CANONICO. IL CONTRIBUTO DELLA SECONDA SCOLASTICA ALLO SVILUPPO DEL MODERNO CONCETTO DI NEGOZIO GIURIDICO

The present thesis of Doctorate of Research introduces a critical study of the modern discussion on the promise obligation, according to the theological-juridical contract docrine of the late scolastics in the sixteenth and seventeenth centuries, and of his contribution to the development of the modern concept of "juristic act". The analysis of treatises "De iustitia et iure" has demonstrated the promissory economy (essence) of contracts and of similary figures and the varied normative efficacy of promises that are binding as a means of exercise of moral virtue of commutative justice, liberality, promise-keeping ("fidelitas"), "amicitia".
