The purpose of this research is to examine the dynamics of administrative procedure which are peculiar to the field of Common Agricultural Policy (CAP). It has been observed that the longevity of CAP’s objectives, which have remained unchanged since 1957, is due to their flexibility and adaptability to different situations; abovementioned characteristics occur also when we consider the principles, as they are an integral part of the CAP (market unity, Community preference, financial solidarity). It has also been examined how the Commission’s authority has increased, in such a way as to transform it into an effective “controlling organ” for the Members States, assuring proper implementation of the EU decisions, which must always be implemented in a unified manner, avoiding discrimination and unequal treatment. The research focuses on administrative actions concerning the field of agricultural support and market control, as well as authorization procedures for marketing of GM and other specific procedures defining whether these products are dedicated to human or animal consumption. Moreover, issues were examined related to the safeguard clauses, to the adoption of national restrictive measures and to Community constraints to the adoption of such measures. The research emphasizes how the so called principle of sincere cooperation can be a new and interesting way of understanding the “models of administrative intervention” which have till now evolved inside the CAP. It exists, in fact, one cooperative dimension within the CAP, which embodies the relationships among the different subjects (national and European; institutional and non-institutional) involved in the same procedure. A “cooperation” that needs to be perceived positively, as it is aims at reaching Community objectives.
