The decision of the Italian Court of Cassation set out above is one of the few judicial rulings handed down by the highest civil Court that has addressed the issue of the criteria for quantifying non-pecuniary damage resulting from insult behaviour. The court ruling held that such damages should not be quantified on the basis of the criteria hitherto established for the assessment of damages arising from defamation in the press and other mass media, but on the basis of the so-called ‘pure’ equitable criterion provided for in Article 1226 of the Civil Code, as referred to in Article 2056 of the Civil Code. The Author seeks to place the issue within a broader regulatory and doctrinal context, whilst also offering some critical observations.
L’ordinanza della Cassazione in epigrafe è una delle rare pronunce di legittimità ad aver affrontato la questione dei criteri di quantificazione del danno morale conseguente ad ingiuria. La decisione ha ritenuto che tale danno non vada quantificato sulla base dei criteri finora elaborati per la liquidazione del danno da diffamazione a mezzo stampa e con altri mezzi di comunicazione di massa, ma sulla base del criterio equitativo c.d. puro, previsto dall’art. 1226 c.c., richiamato dall’art. 2056 c.c. L’Autore tende a inquadrare la questione in un più ampio contesto normativo e dogmatico, non senza svolgere alcune osservazioni critiche.
