The contribution offers some reflections on the Do No Significant Harm criterion, focusing on its theoretical reconstruction and practical application. Starting from an analysis of the soft law provisions derived from European Regulation no. 852/2020, and of the administrative case law that has developed on the subject, it proposes an interpretation aimedat qualifying it as an expression of the principle of sustainable development.
Il contributo propone alcune riflessioni sul criterio Do No Significant Harm, in punto di ricostruzione teorica e meccanismo applicativo. A partire da una lettura della normativa di soft law derivata dal Regolamento europeo n. 852/2020, e della giurisprudenza amministrativa formatasi sul tema, se ne propone una interpretazione volta a qualificarlo quale espressione del principio di sviluppo sostenibile.
