This contribution examines the relationship between Artificial Intelligence and the Third Sector within the broader context of digital transformation in the third millennium, structuring the analysis across four distinct yet complementary dimensions: philosophical-technological, normative-positive, ethical-legal, and political-institutional. Drawing upon the theory of symbolic transfer — developed within the philosophy of technology from Aristotle through Jonas, Sesink, and Floridi — the study analyses Ministerial Call No. 3/2024 issued by the Italian Ministry of Labour and Social Policies as the first national financial measure specifically dedicated to AI in the non-profit sector. It reconstructs its legal foundation in Article 72 of Legislative Decree No. 117/2017, the procedural sequence (Directorate Decrees No. 370/2024; No. 312/2025; No. 368/2025), and its systematic interaction with Regulation (EU) 2024/1689 (“AI Act”). From a law-and-policy perspective, the analysis focuses on the distinction between transferable and non-transferable symbolic functions, the notion of algorithmic accountability, and the conditions for a legally oriented governance of innovation within the Third Sector.
Il presente contributo esamina il rapporto tra Intelligenza Artificiale e Terzo Settore nel contesto della trasformazione digitale del terzo millennio, articolando la riflessione su quattro piani distinti e complementari: filosofico-tecnico, normativo-positivo, etico-giuridico e politico-istituzionale. Muovendo dalla teoria del trasferimento simbolico – elaborata nella tradizione della filosofia della tecnica da Aristotele fino a Jonas, Sesinke e Floridi – lo studio analizza l’Avviso n. 3/2024 del Ministero del Lavoro e delle Politiche Sociali quale primo intervento finanziario nazionale dedicato all’IA nel non-profit. Ne vengono ricostruiti il fondamento nell’art. 72 del D.Lgs. 117/2017, la sequenza procedimentale (D.D. n. 370/2024; D.D. n. 312/2025; D.D. n. 368/2025) e l’interazione sistematica con il Regolamento (UE) 2024/1689 (“AI Act”). La riflessione di politica del diritto si concentra sulla distinzione tra funzioni simboliche trasferibili e non trasferibili, sulla nozione di accountability algoritmica e sulle condizioni di una governance giuridicamente orientata dell’innovazione nel Terzo Settore.
