The contribution comments on the judgments by which the administrative courts annulled the Salvini Decree (Ministerial Decree No. 226 of 16 January 2024), a measure which, within the framework of non-scheduled local public transport and with specific reference to NCC services, laid down the implementing provisions concerning the electronic service log, pursuant to the current Article 11(4) of Framework Law No. 21 of 15 January 1992. After systematizing the various grounds of illegality affecting the decree, the article places these rulings within the broader evolutionary context of the sector, characterised by the intervention of independent administrative authorities (the Italian Competition Authority and the Transport Regulation Authority), the constitutional and EU courts, as well as the European Commission, in order to highlight the persistent regulatory shortcomings and, consequently, the difficulty of political actors in responding to the repeated calls for greater liberalisation and competition among market operators.
Il contributo costituisce un commento alle sentenze con cui il giudice amministrativo ha annullato il decreto Salvini (d.i.m. 16 gennaio 2024, n. 226), atto che, nell’ambito del trasporto pubblico locale non di linea e con riferimento al servizio NCC, ha individuato le previsioni di attuazione relative al foglio di servizio in formato elettronico, ai sensi dell’attuale art. 11, comma 4 della legge quadro 15 gennaio 1992, n. 21. Sistematizzati i molteplici profili di illegittimità del decreto, il lavoro inserisce le pronunce nel più ampio contesto evolutivo del settore, caratterizzato dall’intervento delle autorità amministrative indipendenti (AGCM e ART), del giudice costituzionale ed eurounitario, nonché della Commissione europea, al fine di mettere in evidenza le persi- stenti criticità regolatorie e, dunque, la difficoltà della politica a operare secondo i molteplici richiami alla maggiore liberalizzazione e concorrenza fra gli operatori economici del mercato.
