The article offers a critical analysis of Italian Constitutional Court Judgment No. 107/2025, which upheld the constitutionality of Article 385(3) of the Criminal Code as interpreted by settled case law extending the offence of escape from house arrest to persons under investigation. The paper reconstructs the Court’s reasoning, focusing on its decision to identify the possible literal meanings of the statutory provision by reference to the “technical linguistic code” in force at the time of its enactment rather than to contemporary legal terminology. After examining the systemic implications of this approach and the consequences that would have followed had the constitutional challenge been upheld, the article highlights its theoretical shortcomings, particularly in relation to the principles of legality, legal certainty, foreseeability of criminal sanctions, and the prohibition of analogy in malam partem.
L’articolo analizza criticamente la sent. Cost. n. 107 del 2025, con cui è stata dichiarata non fondata la questione di legittimità costituzionale relativa all’art. 385, comma 3, c.p., nella parte in cui, per come interpretato nel diritto vivente, estende il reato di evasione dagli arresti domiciliari anche all’indagato. Il contributo ricostruisce il ragionamento della Corte, soffermandosi sulla scelta di individuare i possibili significati letterali della disposizione facendo riferimento al “codice linguistico” vigente al momento della sua adozione, anziché a quello attuale. Dopo aver esaminato le implicazioni sistematiche di tale soluzione e le conseguenze che sarebbero derivate da un eventuale accoglimento della questione, l’articolo evidenzia le criticità teoriche dell’approccio seguito dalla Consulta, con particolare riguardo ai principi di legalità, tassatività, prevedibilità della sanzione penale e divieto di analogia in malam partem.
