"Per una cultura dell'istruttoria", al di là della riserva di scienza, nell'affrontare il cambiamento climatico

Climate change governance is a critical test for the relationship between political discretion, legislation and scientific knowledge in constitutional systems. Drawing on the notion of post-normal science, this paper argues that uncertainty is an intrinsic feature of climate decision-making and must be handled through appropriate procedural safeguards. Focusing on the Italian context, the analysis examines the constitutional principle of the “reservation of science”, highlighting its role in requiring scientific scrutiny while offering limited guidance on advisory practices. Recent proposals to establish a national climate advisory body reveal consensus on the need for expertise but persistent ambiguity regarding expert selection and procedures. A stronger culture of scientific inquiry is essential, grounded in transparency, plural expertise and explicit communication of uncertainty as a condition for legitimate climate policymaking.
