The article examines Italian constitutional identity in matters of religion in the light of Constitutional Court judgments No. 125 and No. 20 of 2025. Judgment No. 125 of 2025 reinforces the concept of the essential and unmodifiable core of the Constitution, which can also be inferred on the basis of historical and textual interpretive criteria. Judgment No. 20 of 2025 confirms the coverage of Article 7, second paragraph, of the Constitution also with respect to concordatarian modifications, thereby consolidating the framework originally envisaged by the Constituent Assembly. On this basis, the contribution reconstructs the genesis of the concordatarian counter-limits and distinguishes the plane of constitutional identity from that of the treaty sources governing relations with the Catholic Church. The central thesis is that constitutional identity coincides with the principle of separation of orders and of mutual independence and sovereignty between State and Church and that the model of bilateral relations with religious organizations is indispensable. Finally, the article highlights the persistent marginal applicability of the principle of laicità, which suffers from a general political and normative deficit that limits its full implementation.
L’articolo esamina l’identità costituzionale italiana in materia religiosa alla luce delle sentenze costituzionali n. 125 e n. 20 del 2025. La sentenza n. 125 del 2025 rafforza il concetto del nucleo essenziale immodificabile della Carta, evincibile anche sulla scorta di criteri interpretativi storici e testuali. La sentenza n. 20 del 2025 conferma la copertura dell’art. 7, secondo comma, Cost. anche alle modificazioni concordatarie, irrigidendo il tratto disegnato in origine dai Costituenti. Su questa base, il contributo ricostruisce la genesi dei controlimiti concordatari e distingue il piano dell’identità costituzionale da quello delle fonti bilaterali con la Chiesa cattolica. La tesi centrale è che l’identità costituzionale coincida con il principiodi separazione degli ordini, di indipendenza e sovranità reciproca tra Stato e Chiesa e che il modello di bilateralità nei rapporti con le confessioni religiose sia irrinunciabile. È infine evidenziata la persistente marginalità applicativa della laicità, che soffre di deficit politico e normativo generale, che ne limita la piena attuazione.
