In light of recent EU initiatives that have revitalized information and consultation rights as mechanisms of worker involvement capable of addressing the new challenges posed by artificial intelligence and algorithmic management, this article investigates, by means of comparative analysis, current role and prospects of these rights within the Italian legal system. By comparing the Italian framework with the French model – characterized by pervasive information and consultation rights ensuring a more homogeneous level of worker involvement across the various impacts of the digital transition – the article highlights the variable geometry of the Italian system, which oscillates between mere information obligations and the far more incisive mandatory negotiation procedure provided under Article 4 of the Workers’ Statute. From this perspective, despite their traditional underestimation, information and consultation rights emerge as the very core of the system, necessary to address the impact of the different technologies progressively being introduced into the workplace. The analysis of sectoral collective bargaining agreements – to which the legislative decree implementing Directive 2002/14/EC largely delegates the regulation of these rights within the domestic system – reveals, especially when compared with the French experience, significant structural shortcomings both in terms of the objective scope of application regarding new technologies and with reference to the procedures and timing of consultation. On the basis of these findings, the Author advocates taking advantage of the emerging European regulatory pathways in order to fill existing gaps and relaunch, both normatively and culturally, a form of involvement that enables employees’ representatives to exert influence over decision-making processes concerning the introduction of AI technologies and algorithmic management systems, whether in pursuit of more collaborative industrial relations or within the traditional framework of adversarial participation.
Fronte delle iniziative euro-unitarie che hanno rilanciato l’informazione e consultazione quale forma di coinvolgimento atta a rispondere alle nuove sfide poste dall’intelligenza artificiale e dal management algoritmico, il contributo indaga, con l’ausilio del metodo comparato, quale sia l’attuale ruolo e quali siano le prospettive future di tale istituto all’interno dell’ordinamento interno. Grazie alla comparazione con l’ordinamento francese, caratterizzato da pervasivi diritti di informazione e consultazione che definiscono un livello omogeneo di coinvolgimento per i diversi impatti della transizione digitale, è possibile apprezzare pienamente le geometrie variabili del sistema italiano, che si muove tra il mero obbligo di informazione e la ben più incisiva procedura concertativo-autorizzatoria dell’art. 4 dello statuto dei lavoratori. In questo senso, nonostante la tradizionale sottovalutazione, i diritti di informazione e consultazione si configurano come il baricentro del sistema, necessario al fine di dare copertura agli impatti di diverse tecnologie in via di introduzione in azienda. L’analisi della contrattazione collettiva di settore, cui il decreto legislativo di recepimento rimette in massima parte l’attuazione alla Direttiva 2002/14/CE nell’ordinamento interno, consente, sempre in raffronto con l’esperienza d’Oltralpe, di rilevarne le carenze strutturali tanto in termini di ambito applicativo oggettivo rispetto alle nuove tecnologie quanto con riferimento alle modalità e alle tempistiche della consultazione. Da tali conclusioni discende l’invito, da parte dell’Autore, ad approfittare dei nuovi percorsi normativi in sede europea per colmare le lacune e rilanciare, sul piano normativo e su quello culturale, una forma di coinvolgimento che consente ai rappresentanti dei lavoratori di avere una influenza sui processi decisionali relativi all’introduzione delle tecnologie dell’IA e dell’algorithmic management, che può risultare funzionale tanto a logiche maggiormente collaborative quanto alle più tradizionali logiche di partecipazione conflittuale.
