The power of the judge to amend the classification of the criminal offence, which has given rise to well- known issues since earlier periods, has found its most significant source of tension in the case law of the supranational courts. On the one hand, a key role has been played by the European Court of Human Rights’ judgment in the Drassich case, although its driving force has by now largely been exhausted, having been neutralized by domestic practice. On the other hand, a renewed challenge has emerged from the case law of the European Court of Justice, notwithstanding the tendency of domestic case law to neutralize it. Drawing together the threads of both the national and supranational evolution of the iura novit curia principle, this paper seeks to examine whether it is possible to ensure the urgently needed adaptation of domestic law to European sources of law.
Il potere del giudice di riqualificare il fatto, all’origine di problematiche note già in epoche risalenti, ha visto soltanto nella giurisprudenza delle Corti sovranazionali il decisivo fattore di crisi. Per un verso, ha giocato un ruolo determinante la pronuncia della Corte edu nel caso Drassich, nonostante la sua spinta propulsiva si sia ormai esaurita, sterilizzata dalla prassi interna. Per altro verso, una rinnovata messa in discussione degli assetti codicistici viene dalle decisioni della Corte di giustizia dell’Unione europea, per quanto anche queste siano vittima di un’analoga tendenza alla neutralizzazione da parte della giurisprudenza di legittimità. Il contributo, tirate le fila dell’evoluzione, nazionale e sovranazionale, del canone iura novit curia, punta a sondare come sia possibile garantire l’improcrastinabile adeguamento della disciplina interna alle fonti europee.
