In Judgment No. 29593 of 2025, the Italian Court of Cassation reaffirmed the continuing applicability of the non-refoulement prohibition as a safeguard of the right to respect for private and family life under Article 8 of the European Convention on Human Rights (ECHR), even following the amendments introduced to Article 19(1.1) of the Consolidated Immigration Act by Decree-Law No. 20 of 2023. These amendments repealed the criteria according to which the level of integration achieved by an applicant for protection in the Italian territory – previously to be balanced against that in the country of origin or provenance for the purposes of granting national protection – was to be assessed. This commentary examines the ruling by situating it within the relevant legislative and jurisprudential framework, in order to explore its innovative scope, not only with regard to the extent of protection afforded to private and family life, but also in relation to its connection with the constitutional right of asylum.
Con la sentenza n. 29593 del 2025 la Corte di cassazione ha confermato la vigenza del divieto di refoulement per tutela del diritto al rispetto della vita privata e familiare ex art. 8 CEDU anche a seguito delle modifiche apportate all’art. 19, comma 1.1, TUI dal decreto-legge n. 20 del 2023, che ha abrogato i criteri in forza dei quali debba essere valutato il livello di integrazione raggiunto da un richiedente protezione sul territorio italiano, da raffrontarsi con quello del Paese di origine o di provenienza ai fini del riconoscimento della protezione nazionale. Il commento analizza la pronuncia collocandola all’interno della cornice normativa e giurisprudenziale di riferimento per indagarne la portata innovativa, non solo per quel che riguardi il perimetro applicativo della tutela della vita privata e familiare ma anche per il legame che unisca questa al diritto di asilo costituzionale.
