The proliferation of specialized knowledge presents a significant challenge for judicial activity. Judges are increasingly called upon to decide cases involving technical or scientific issues that fall outside their areas of expertise, making the role of experts in fact-finding essential. This article provides an overview of the main theoretical approaches to determining when an expert deserves the judge’s trust. It focuses on two key questions: under what conditions can an individual be considered an expert, and to what extent is judicial deference to the expert justified?
