This article examines the impact of digital nomadism on the system of connecting factors set out in Article 8 of the Rome I Regulation for determining the law applicable to employment contracts. The paper highlights the limits of the current framework, particularly the practical and conceptual challenges involved in identifying a habitual place of work and in applying the indicators that reveal the closest connection. The author explores the possibility of a more adequate regulatory approach to this emerging work reality, notably discussing whether greater weight might be placed on party autonomy. From this perspective, the article reflects on possible approaches for adapting the system, including an amendment of Article 8, the use of soft law instruments, and emerging forms of transnational regulation.

Le présent article analyse l’impact du nomadisme numérique sur le système de rattachement prévu à l’article 8 du règlement Rome I pour la détermination de la loi applicable aux contrats de travail. Il met en évidence les limites du cadre actuel, en particulier les difficultés pratiques et conceptuelles liées à l’identification d’un lieu habituel d’exécution du travail et à l’application des indices permettant de révéler le lien le plus étroit. L’autrice examine la possibilité d’une approche réglementaire plus adéquate face à cette nouvelle réalité du travail, notamment en s’interrogeant sur l’opportunité d’accorder un rôle plus important à l’autonomie des parties. Dans cette perspective, l’article envisage diverses voies d’adaptation du système, incluant une éventuelle révision de l’article 8, le recours à des instruments de soft law, ainsi que l’émergence de nouvelles formes de régulation transnationale.
