The article examines Judgment No. 48 of 2025 by the Constitutional Court, which rejected the question raised against Article 1 of Puglia Regional Law no. 22 of 2024, which establishes that enrollment in educational programs for children aged 11-25 is conditional upon the submission of documentation certifying, alternatively: administration of the Human Papilloma Virus (HPV) vaccine, commencement of the vaccination program, refusal of vaccination, or completion of an informational interview with health services regarding the benefits of the vaccine. In any case, the possibility of expressing a «formal refusal» to produce any document is still contemplated. The most interesting aspects of the decision include: the clarification of the scope of the Region’s legislative powers regarding health care and education, in cases where it does not impose a vaccination obligation but merely solicits informed consent to promote HPV vaccination; the recognition, for the first time, of the importance of «informed dissent» which ensures that any refusal to vaccinate is made in an informed manner, after receiving accurate information on the benefits of prophylaxis.
