Closed centres located in Albania and under Italian jurisdiction have been operational for almost a year. However, their use is controversial as they are intended to detain foreign nationals apprehended while crossing the border during ‘checks’, while their ‘asylum’ applications are being examined and their possible ‘return’ is being organised in accordance with the European Pact on Migration and Asylum, which is due to enter into force in June 2026. Until then, previous European texts, which are more stringent on the exceptional conditions justifying administrative detention, remain applicable. Thus, while it is likely that asylum seekers will largely be detained in closed centres – like those in Albania – in the future, the Italian government's intentions have so far been blocked by the judiciary, which refers to the legislation in force, wich is strictly governing the detention of applicants for protection.

Les centres fermés situés en Albanie et placés sous la juridiction italienne sont opérationnels depuis presque un an. Toutefois, leur usage fait débat puisqu’ils ont vocation à maintenir en rétention les ressortissants étrangers appréhendés lors de leur franchissement de la frontière le temps de leur « contrôle », de l’examen de leur demande d’« asile » et l’organisation de leur éventuel « retour » conformément au Pacte européen sur la migration et l’asile dont l’entrée en vigueur est prévue pour juin 2026. Or, d’ici là, les textes européens précédents, plus exigeants sur les conditions exceptionnelles justifiant la rétention administrative, demeurent applicables. Ainsi, s’il est probable que les demandeurs d’asile puissent largement être retenus dans des centres fermés – à l’image de ceux albanais - au futur, la volonté du gouvernement italien se heurte jusqu’à présent au pouvoir judiciaire qui se réfère à la législation en vigueur régissant strictement la rétention des demandeurs de protection.
