Una nuova declinazione processuale per i modelli familiari

The Cartabia reform, in the area dedicated to family and juvenile justice, has profoundly changed the rules of the legal proceedings, and with them the relationship between the judgement itself and the underlying substantive rights and institutions. The reform identifies a unitary and homogeneous model, endowed with the indispensable procedural guarantees, with possible diversified declinations for the different proceedings and thus for the individual subject areas of the law of persons, children and families. Lawyers are now called upon to new responsibilities and duties, in respect not only of the position of their clients, but also of a higher framework of values. And in this perspective, they must also carefully reconsider the meaning of alternative (or complementary) methods of consensual justice, which can lead to the settlement of disputes not through adversarial and contentious litigation, but through dialogue and mutual respect.

La riforma Cartabia, nella parte dedicata alla giustizia familiare e minorile, ha mutato in modo profondo i lineamenti del processo, e con essi il rapporto intercorrente tra il giudizio stesso e i sottostanti diritti e istituti sostanziali. La riforma individua un modello unitario e omogeneo, dotato delle indispensabili garanzie processuali, con possibili declinazioni diversificate per i diversi procedimenti e dunque per le singole aree tematiche del diritto delle persone, dei minori e delle famiglie. In tale sede l’avvocato è chiamato a nuove responsabilità e doveri, nel rispetto non soltanto della posizione del proprio assistito, ma altresì di una più elevata cornice di valori. E in tale prospettiva, egli deve anche rimeditare attentamente sul significato dei metodi alternativi o complementari di giustizia consensuale, che possono portare a soluzione della controversia non avversariale e contenziosa, ma attraverso il dialogo e il rispetto reciproco.
