The Covid-19 related public health emergency required the implementation of intrusive measures with reference to the privacy of employees for the purposes of the protection of health and safety of the employees against the spread of the infection. These emergency-related measures and information processing have been unprecedented in terms of object and methods compared to the ordinary data processing practices carried out in the workplace. Considerable uncertainties have arisen with respect to the regulatory framework resulting from the integration between labour and data protection disciplines for the abovementioned data processing. These uncertainties have not been completely allayed by the specific regulatory interventions provided during the pandemic. The contribution analyses the regulations applicable to the different processing of workers’ data by taking an interest in roles and functions, as well as constraints and methods of data processing by employers. It can be asserted that this data processing questioned the boundaries between public interest and employers’ responsibilities, so that the lessons learned in the emergency context will prove useful for managing the boundaries between workers’ and citizens’ health and safety that are deemed to be under serious pressure in the near future.
L’emergenza sanitaria ha richiesto, ai fini della tutela della salute e sicurezza dei lavoratori rispetto alla diffusione del contagio, la predisposizione di misure invasive rispetto alla privacy dei dipendenti, inedite per oggetto e modalità rispetto agli ordinari trattamenti di dati posti in essere nei contesti aziendali. Notevoli incertezze sono sorte rispetto al quadro normativo risultante dalla inte- grazione tra discipline lavoristiche e di data protection per questi trattamenti di dati, incertezze che nemmeno una specifica attenzione normativa è riuscita a fugare del tutto. Il contributo analizza le discipline applicabili ai diversi trattamenti di dati dei lavoratori interessandosi di ruoli e funzioni, così come vincoli e modalità dei trattamenti da parte dei datori di lavoro. Questi trattamenti hanno inter- rogato i confini tra interesse pubblico e responsabilità datoriali, cosicché le lezioni apprese nel conte- sto emergenziale si riveleranno utili per la gestione dei confini tra salute del lavoratore e salute del cittadino.
