The piece analyses the recent judgment of the District Court of The Hague in Greenpeace v. the Netherlands, focusing on the Court’s engagement with cultural rights in the context of climate change and its implications for future litigation. We argue that while the judgment marks an important step in recognising climate-related cultural harm, its reliance on Article 8 ECHR limits the normative depth of its reasoning and that it leaves important questions concerning reparations unresolved.

Abstract
The piece analyses the recent judgment of the District Court of The Hague in Greenpeace v. the Netherlands, focusing on the Court’s engagement with cultural rights in the context of climate change and its implications for future litigation. We argue that while the judgment marks an important step in recognising climate-related cultural harm, its reliance on Article 8 ECHR limits the normative depth of its reasoning and that it leaves important questions concerning reparations unresolved.File in questo prodotto:
