Starting from the findings emerging from practice regarding the complexity and evolution of the arbitrator’s role in the framework drawn also by the other forms of alternative dispute resolu- tion tools, the essay addresses questions arising from the appointment of arbitrators without ne- glecting that it constitutes a crucial “privilege” for the parties, capable of influencing the entire decision-making process. The author emphasizes the importance of careful negotiation of arbi- tration clauses, the impact of multi-tiered clauses, and the central role of balancing private au- tonomy, formal independence, and substantial impartiality. Finally, the paper underlines that transparency, fairness, and an open-minded approach are essential conditions to ensure the ef- fectiveness and credibility of the arbitral process.
Il saggio, prendendo le mosse da constatazioni emergenti dalla prassi in ordine alla complessità e all’evoluzione del ruolo dell’arbitro nel quadro anche di altre forme di risoluzione alternativa delle controversie, affronta il problema della scelta dell’arbitro senza trascurare che costituisce un “privilegio” cruciale per le parti, capace di influenzare l’intero processo decisionale. L’autore mette in luce l’importanza di una negoziazione attenta delle clausole compromissorie, l’impatto delle clausole multi-tiered e la centralità del bilanciamento tra autonomia privata, indipendenza formale e imparzialità sostanziale. Viene infine sottolineato come trasparenza, correttezza e ap- proccio open-minded rappresentino condizioni essenziali per garantire l’efficacia e la credibilità del procedimento arbitrale.
