Vilipendio della bandiera e libertà di espressione negli Stati Uniti d’America nell’era di Donald Trump = Flag desecration and freedom of expression in the United States in the era of Donald Trump

The present essay deals with the recent developments regarding flag desecration in the United States after the adoption of the Executive Order “Prosecuting Burning of the American Flag” on August 25, 2025 by President Donald Trump. After reviewing its contents and comparing them with the doctrine of the Supreme Court, especially with the precedent in Texas v. Johnson (1989), it will attempt to understand whether this Executive Order is compatible with the constitutional right to freedom of expression under the First Amendment and whether the current Supreme Court – which is facing a specific political strategy of the federal Administration – could possibly change its interpretation on the matter.

Il presente saggio intende commentare i recenti sviluppi in materia di vilipendio della bandiera negli Stati Uniti, prendendo spunto dall’Executive Order “Prosecuting Burning of the American Flag”, adottato il 25 agosto 2025 dal Presidente Donald Trump. Dopo averne ripercorso i contenuti e confrontati questi con la giurisprudenza della Corte Suprema, soprattutto con il precedente di Texas v. Johnson (1989), si cercherà di comprendere se questo Executive Order è compatibile con il diritto costituzionale alla libertà di espressione di cui al Primo Emendamento e se la stessa Corte Suprema – a fronte di una specifica strategia politica dell’Amministrazione federale potrebbe eventualmente mutare la propria interpretazione in materia.
