La montagna incantata: tra passione e responsabilità civile

This paper aims to analyze an unpublished judgment of the Court of Trento, civil section, judgment April 6, 2020 (dep. April 9, 2020), thanks to which the opportunity is taken to take stock of civil liability in skiing. We will observe, first, the historical evolution of the subject; second, the legal nature of the contract between the operator of the facility and the customer (skier) and the duties of the parties; then, we will get into the ”heart” of civil liability skiing trying to understand the conditions for its existence. Finally, the delicate topic of the so-called loss of chance and the respective problematic evidentiary profile will be discussed.

Il presente elaborato vuole analizzare una inedita sentenza del Tribunale di Trento, sezione civile, sentenza 6 aprile 2020 (dep. 9 aprile 2020), grazie alla quale si coglie l´occasione per fare il punto sulla responsabilità civile in materia sciistica. Si osserverà, in primis, l´evoluzione storica della tematica; in secundis, la natura giuridica del contratto tra gestore dell´impianto e il cliente (sciatore) ed i doveri delle parti; in secundis, si entrerà nel ”vivo” della responsabilità civile sciistica cercando di capire le condizioni per la sua sussistenza. Infine, si tratterà il delicato tema della c.d. perdita di chance ed il rispettivo problematico profilo probatorio.
