IL FASCICOLO SANITARIO ELETTRONICO NELLO SPAZIO EUROPEO DEI DATI SANITARI TRA DIRITTI DEL PAZIENTE E UTILIZZO SECONDARIO DEI DATI

The paper explores the delicate balance between safeguarding patients’ rights and enabling the secondary use of health data in light of the European Health Data Space (EHDS) Regulation. It outlines the European legal framework and highlights the challenges concerning data protection, privacy, and the risks of re-identification. The analysis then focuses on the role of Italy’s Electronic Health Record (Fascicolo Sanitario Elettronico, FSE), particularly its updated 2.0 version strengthened by the National Recovery and Resilience Plan (NRRP). The study emphasizes the FSE’s potential as a strategic tool for interoperability and research, while also addressing critical issues related to citizens’ trust and the management of consent.

Il contributo analizza il delicato equilibrio tra la tutela dei diritti dei pazienti e l’utilizzo secondario dei dati sanitari alla luce del Regolamento europeo sullo Spazio Europeo dei Dati Sanitari (EHDS). Dopo aver ricostruito il quadro normativo europeo ed evidenziato le sfide legate alla protezione dei dati personali, alla privacy e ai rischi di re-identificazione, l’articolo esamina il ruolo del Fascicolo Sanitario Elettronico (FSE) in Italia, anche nella sua versione 2.0 potenziata dal PNRR. L’analisi mette in luce le potenzialità del FSE quale strumento strategico per l’interoperabilità e la ricerca, ma anche le criticità connesse alla fiducia dei cittadini e alla gestione del consenso.
