L’infortunio sul lavoro del lavoratore senza tempo e luogo di lavoro predeterminati

The essay aims to reconstruct the meaning of accidents at work and, in particular, the injury at work in the case of harmful events occurring to workers who perform their work without predetermined working hours and locations. After reconstructing the evolution of the interpretation of the injury at work, the essay addresses the various issues that work without predetermined hours and location raise in terms of the application of compulsory insurance and, more generally, the constitutionally relevant distinction between the protection reserved for occupational events and that provided for events not related to work.

Il saggio intende ricostruire il significato dell’infortunio sul lavoro e, in particola-re, del presupposto costituito dall’occasione di lavoro nel caso di eventi lesivi occorsi ai lavoratori che svolgono la prestazione lavorativa senza un orario e luogo di lavoro predeterminati. Dopo aver ricostruito l’evoluzione dell’interpretazione dell’occasione di lavoro il saggio affronta le diverse questioni che il lavoro senza orario e luogo predeterminati pongono sul piano dell’applicazione dell’assicurazione obbligatoria e più in generale della distinzione costituzionalmente rilevante tra la tutela riservata agli eventi professionali e quella prevista per gli eventi privi di origine lavorativa.
