This work documents Wesley Newcomb Hohfeld’s influence on John Rogers Commons, one of the leading figures of Old Institutionalism. Both Hohfeld and Commons offer a contribution in the understanding of the adversarial nature of jural relations. We try to reformulate these contributions by the con- cept of positionality as introduced by Fred Hirsch.
