La diversificazione degli standard di prova nel processo penale e nel rapporto fra giurisdizioni = Diversification of Standards of Proof in Criminal Procedure and in the Relationship Between Jurisdictions

This paper examines the regulatory technique used by the Italian legislator in art. 533 of the Italian Criminal Procedure Code, testing its accordance with the outcomes of the recent philosophical debate on the standards of proof. After arguing in favour of a “Baconian” view of the bard rule, the article claims that the difference between the standards of proof, as required in the various stages of the Italian criminal proceeding, must be conceived quanti- tatively. This criterion also separates criminal and civil contexts and is aimed at the protection of specific interests.

Il presente lavoro analizza la tecnica normativa impiegata dal legislatore italiano nell’art. 533 c.p.p., al fine di verificarne la compatibilità con i suggerimenti emersi nel recente dibattito filoso- fico sul tema degli standard probatori. Assunta una prospettiva “baconiana” della bard rule, si sostiene una relazione quantitativa fra le soglie decisorie operanti nelle varie fasi del procedimen- to penale e nei rapporti fra quest’ultimo e il processo civile. Una relazione fondata sul diverso grado di conferma probatoria richiesto dal legislatore per la prova di determinati fatti e in vista della preferenza accordata a determinati interessi.
