This essay analyses EU Regulation 1689/2024 on Artificial Intelligence (AI) from the perspective of Italian labour law. The paper examines the framework of the Regulation based on the graduation of risks arising from AI, focusing firstly on prohibited systems (such as social scoring, emotion recognition and biometric categorisation of employees) and secondly on permitted high-risk systems. In relation to the latter, the study analyses what duties are imposed on providers and deployers –such as employers– and assesses these duties from a critical perspective. Special attention is paid to individual and collective information rights and human supervision obligations. In the final part, the author explores the connections between the European IA Regulation and the Italian legislation on workers' health and safety (Dlgs. 81/2008), highlighting the lack of innovative scope of the European Regulation from the point of view of the protection of this fundamental right of employees.

Abstract

Este ensayo analiza el Reglamento 1689/2024 de la UE en materia de Inteligencia Artificial (IA) desde la perspectiva del derecho laboral italiano. El trabajo examina el marco estructurador del Reglamento basado en la graduación de los riesgos derivados de la IA, centrándose, en primer lugar, en los sistemas de prohibidos (tales como como la «evaluación social», el reconocimiento de emociones y la categorización biométrica de los trabajadores) y, en segundo lugar, en los sistemas de alto riesgo permitidos. En relación con estos últimos, el estudio analiza qué deberes se le imponen a los proveedores y responsables del despliegue –como son los empresarios en el ámbito laboral–, evaluando tales deberes desde una perspectiva crítica. Se presta especial atención a los derechos de información individuales y colectivos y a las obligaciones de supervisión humana. En la parte final, el autor profundiza en las conexiones entre el Reglamento europeo de IA y la legislación italiana en materia seguridad y salud de los trabajadores (Dlgs. 81/2008), poniéndose de relieve el nulo alcance innovador del Reglamento europeo desde el punto de vista de la protección de este derecho fundamental de los trabajadores.
