Despite Latin-American constitutionalism and Western constitutionalism share common origins, the characteristics of the first one influenced on the constitutional experimentalism. Indigenous roots characterized the recent democratic reformism since they are the basis for the birth of the ‘Nuevo Constitucionalismo’ theory, differing from Western constitutional theory that is individualist and liberalistic. From a cultural and anthropological point of view, the new Latin-American constitutional theories have the purpose to build a collective, communitarian, cultural and geocentric policy. The essay aims to analyse the historical, legal, and political development of the Latin-American constitutionalism in the light of the importance, and the influence of the indigenous determinant.

Abstract

Despite Latin-American constitutionalism and Western constitutionalism share common origins, the characteristics of the first one influenced on the constitutional experimentalism. Indigenous roots characterized the recent democratic reformism since they are the basis for the birth of the ‘Nuevo Constitucionalismo’ theory, differing from Western constitutional theory that is individualist and liberalistic. No obstante, los orígenes comunes entre el constitucionalismo latinoamericano y el constitucionalismo occidental, el primero tiene sus propias características que han influido en el experimentalismo constitucional. Particularmente, la presencia cultural del indígena ha caracterizado el reciente reformismo democrático, constituyendo la fuente para el nacimiento de la teoría del Nuevo Constitucionalismo, es decir, una lectura constitucional que se distingue del constitucionalismo individualista y liberalista del mundo occidental y del imperio de los derechos humanos. Desde un punto de vista cultural y antropológico, las nuevas teorías constitucionales latinoamericanas se ponen el objetivo de construir una cara jurídica y política colectiva, comunitaria, cultural y geocéntrica. El ensayo mira a reconstruir la historia jurídica y política del constitucionalismo iberoamericano a la luz de la importancia y de la influencia de la determinante indígena.
