Le manifestazioni fasciste e l’attualità della XII disposizione finale della Costituzione

This article examines the legal provisions intended to prevent the reorganization of the Fascist party, with particular attention to those that criminalize fascist expressions and public displays. The resulting legal framework appears fragmented and inconsistent, marked by contradictions, ambiguities, and interpretative uncertainties—further exacerbated by overlaps with legislation addressing the incitement of racial hatred. The analysis raises the critical question of whether the criminalization of fascist symbols and gestures may have inadvertently weakened, rather than reinforced, the understanding and normative force of the XII Final Provision of the Italian Constitution, thereby diminishing its practical effectiveness.

L’esame delle disposizioni volte a impedire la riorganizzazione del partito fascista, e in particolare di quelle che puniscono le relative manifestazioni, rivela un quadro caotico, ricco di contraddizioni, ambiguità e problemi interpretativi, aggravati anche dalla sovrapposizione con le norme contro la diffusione dell’odio razziale: ci si domanda, quindi, se la criminalizzazione delle manifestazioni esteriori fasciste non abbia in realtà indebolito, più che rafforzato, la percezione del significato e del valore della XII disposizione finale della Costituzione, contribuendo a minarne l’efficacia.
