The paper aims to analyse the strategies and regulatory measures adopted in two different legal systems, the Italian and the French, to respond to the challenge of keeping a workforce increasingly affected by long-term or chronic pathological conditions at work. By analysing how different legal systems address the same social and economic problems, the comparative method, applied in its traditional functionalistic approach, allow to identify the different elements of the regulation, their connections and their functions in the context of the national legal systems, contributing to the overall understanding of the legal solutions adopted in each country. The comparison between a legal system that has adopted a systematic approach to the phenomenon and a legal system, such as the Italian one, which has put in place a few specific but disconnected measures, made it possible to better identify shortcomings and possible policy action to improve the regulation in the Italian context.

Abstract

The paper aims to analyse the strategies and regulatory measures adopted in two different legal systems, the Italian and the French, to respond to the challenge of keeping a workforce increasingly affected by long-term or chronic pathological conditions at work.
