L’incerto avvio delle riforme in tema di disabilità previste dalla legge n. 227 del 2021 = The uncertain start of the disability reforms provided for in Law No. 227 of 2021

This paper explores the difficulties surrounding the implementation of the complex reform process on disability initiated by Law No. 227 of 2021. More than three and a half years after the approval of the law, numerous amendments have been introduced, while at the same time, several implementing measures have yet to be adopted. This is an affair that emblematically confirms — in a domain that directly impacts fundamental rights — the difficulties encountered in the Italian legal system when it comes to implement primary legislation.

Il saggio indaga le difficoltà di attuazione del complesso percorso di riforma in materia di disabilità avviato con la legge n. 227 del 2021. A distanza di oltre tre anni e mezzo dall’approvazione della legge, numerosi sono state le modifiche adottate e, allo stesso tempo, i provvedimenti attuativi che ancora non sono stati adottati. Si tratta di una vicenda che conferma emblematicamente – su un tema che incide sui diritti fondamentali delle persone – le difficoltà che nell’ordinamento italiano si riscontrano nel dare attuazione alle fonti primarie.
