Gli strumenti intramurari ed extramurari a garanzia del diritto alla genitorialità dei padri detenuti. Buone pratiche e criticità

This paper focuses on the condition of imprisoned fathers and the possibilities granted to them to ex-ercise the parental role during the execution of the judgment. The legal framework envisaged by the penitentiary law and by the subsequent regulations on the subject provides for a differentiation of the intramural and extramural tools that can be used by mothers and fathers to exercise their parental role, tracing the stereotype that sees mothers as the only holders of the role of care and fathers as breadwinners, who have lost the possibility of occupying this position in the family, they find them-selves penalized in accessing the enjoyment of the right to affectivity, declined in relation to the off-spring. The analysis of these tools is conducted not only from the point of view of how the provisions are formulated, but also of their concrete application in a sociological perspective.

La condizione dei padri detenuti e le possibilità concesse loro di esercitare il ruolo genitoriale durante l’esecuzione della pena costituiscono l’oggetto di questo articolo. La disciplina prevista dalla legge di ordinamento penitenziario e dalle successive norme in materia prevede una differenziazione degli strumenti intramurari ed extramurari impiegabili da madri e padri per esercitare il loro ruolo genitoriale, ricalcando lo stereotipo che vede le madri come uniche detentrici del ruolo di cura e i padri come breadwinner, che persa la possibilità di occupare questa posizione nella famiglia, si trovano penalizzati nell’accesso al godimento del diritto all’affettività, declinato in relazione alla prole. L’analisi di tali strumenti verrà condotta non solo dal punto di vista di come sono formulate le norme, ma anche della loro concreta applicazione in una prospettiva sociologica.
