The regulation of employment contracts in Fascist Italy provides a unique opportunity to examine the various legal issues that fall within both public and private law. Indeed, as the regulations governing individual and collective labour contracts began to overlap, the traditional distinction between these two legal spheres was called into question. This chapter also addresses other issues in the history of Italian laws and institutions, not only with regard to Fascist Italy, but also Republican Italy. Many of these issues continue to be debated today, such as the traditional stance that employment contracts fall under private law, the public-law repercussions of social security and the legacy and disavowal of corporatism following the fall of fascism.
La disciplina del contratto di lavoro subordinato in Italia nel Ventennio offre l’occasione per riflettere su diversi problemi giuridici a cavaliere tra il diritto privato e il diritto pubblico, tali da metterne in crisi la stessa tradizionale dicotomia specialmente nel combinarsi delle regole sul contratto individuale e sul contratto collettivo di lavoro. Il tema, inoltre, consente di affrontare questioni tuttora controverse nella storia giuridica e istituzionale non solo dell’Italia fascista, ma anche dell’Italia repubblicana, quali la collocazione del contratto di lavoro nell’alveo tradizionale del diritto privato, i risvolti pubblicistici della previdenza sociale, nonché il lascito e il ripudio, insieme, dell’ordine corporativo all’indomani della caduta del regime.
