The aim of the present paper is to analyze how the concepts of guilt and responsibility evolved from Homer to Aristotle. Whereas the former (albeit with two significant exceptions) considers an individual always responsible for an action, regardless of their mens rea, the latter – relying also on the important remarks developed by the sophists in the second half of the fifth century – provides a definition of “intentional” and “unintentional” that ultimately excludes responsibility for individuals who are not guilty of an unintentional action.

Abstract

El objetivo del presente trabajo es analizar cómo los conceptos de culpa y responsabilidad evolucionaron desde Homero hasta Aristóteles. Mientras que el primero (a pesar de dos excepciones significativas) considera que un individuo es siempre responsible por un acto, independientemente de su mens rea, el último (apoyándose también en las observaciones importantes desarrolladas por los sofistas en la segunda mitad del siglo V) ofrece una definición de “intencional” y “no intencional” que a fin de cuentas excluye la responsabilidad de aquellos individuos que no son culpables de un acto no intencional.
