L’uso eccessivo della forza di polizia e gli strumenti per prevenirlo

What is the limit beyond which the use of force by police officers becomes illegitimate violence? This contribution intends to answer this question both by describing the legal constraints posed by international and national legislation and by assessing to what extent these constraints are able to operate in the situation where it is the officer, with his subjectivity and the expectations he feels placed on him, who has to make decisions on how to act, often in a split second. The aim is to point out the importance of moving away from the bad-apple thesis and adopting institutional programmes to prevent the excessive use of force.

Qual è il limite oltre il quale l’uso della forza da parte degli operatori di polizia diven- ta violenza illegittima? Il contributo intende rispondere a questa domanda sia descrivendo i vincoli giuridici posti dalla normativa internazionale e nazionale, sia valutando quanto questi vincoli riescono a operare nella situazione contingente in cui è l’agente, con la sua soggettività e le aspettative che sente riposte su di lui, a dover prendere decisioni su come agire, spesso in pochi istanti. L’obiettivo è di segnalare l’importanza di prendere le distanze dalla tesi della mela marcia e di adottare programmi istituzionali di prevenzione dell’uso eccessivo della forza.
