Il transgenderismo fra diritto alla salute e diritto all’identità di genere: problematiche attuali e prospettive future = Transgenderism between the right to health and the right to gender identity: current issues and future prospectives

The essay aims to delve into the progressive relevance of the right to health in its physical and psychic meanings in the field of gender identity self-affirmation paths, emphasising the importance of language and the evolution of social conscience. The directions along which the proposed analysis moves concern the individual dimension (and therefore the right of access to this pathway), the relational and couple dimension and the parental and procreative dimension. To this end, in the absence of an explicit reference in the Italian Constitution, the decisions rendered by the Constitutional Court on the subject will be taken into particular consideration, with references to the case law of the European Court of Human Rights.

Il saggio approfondisce il progressivo rilievo che assume, in materia di percorsi di autoaffermazione di identità di genere, il diritto alla salute nella sua accezione fisica e in quella psichica, dando rilievo all’importanza del linguaggio e all’evoluzione della coscienza sociale. Le direttrici lungo le quali si muove l’analisi proposta riguardano la dimensione individuale (e dunque il diritto di accesso a tale percorso), la dimensione relazionale e di coppia e la dimensione genitoriale e procreativa. A tale fine saranno prese in considerazione, in assenza di un esplicito riferimento in Costituzione, le decisioni rese dalla Corte costituzionale in materia, con riferimenti alla giurisprudenza della Corte Europea dei Diritti dell’Uomo.
