Environmental space law, a discipline in its infancy, may benefit from two legal tools that are absent from other sectors of international law: 1. state responsibility for national activities in outer space, requiring states to au- thorize and supervise space activities carried out by nationals or from their territory (Article VI, Outer Space Treaty); 2. liability of the launching State for damage caused by space objects (Article VII, Outer Space Treaty, and Liability Convention). These obligations need to be interpreted in light of international environmental law, as including a duty to prevent and to remedy the excessive creation of space debris, today the first source of pollution in Earth orbit. It is in particular the principle of sustainable development that is called to play a key role in the conduct of space activities.

Le droit de l’espace environnemental, une discipline encore naissante, pourrait bénéficier de deux outils juridiques absents dans d’autres secteurs du droit international : 1. la responsabilité internationale des États pour les activités spatiales nationales, qui impose aux États d’autoriser et de superviser de telles activités menées par leurs ressortissants ou depuis leur territoire (article VI du Traité sur l’espace extra-atmosphérique) ; 2. la responsabilité de l’État de lancement pour les dommages causés par des objets spatiaux (article VII du même Traité et Convention sur la responsabilité). Ces obligations devraient être interprétées à la lumière du droit international de l’environnement, comme incluant un devoir de prévenir et de remédier à la création excessive de débris spatiaux, aujourd’hui principale source de pollution en orbite terrestre. En particulier, le principe du développement durable est appelé à jouer un rôle clé dans la conduite des activités spatiales.
