The essay aims to investigate the labour law relevance of legal regulations that give rise to forms of responsible capitalism. Instead of focusing on a single national regulation, the analysis is developed by means of comparative methodology with specific reference to two of the legal systems that have introduced special legislations for companies that pursue social objectives in addition to profit maximisation. Framing the phenomenon of responsible capitalism in the broader debate on sustainability, the study focuses on the implications of the regulation of such companies with respect to the position of workers. Indeed, the latter are affected both as beneficiaries or at least stakeholders of a business activity that is also oriented towards the common benefit, and as subjects directly involved in the pursuit of the mission or (potentially) in its definition.
Attraverso una analisi comparata dei modelli regolativi adottati in Francia e in Italia rispettivamente per le societé à mission e per le società benefit, il saggio intende indagare i profili di interesse per il diritto del lavoro delle normative giuscommerciali che danno vita a forme di capitalismo responsabile. Inquadrato il fenomeno del capitalismo responsabile nel più ampio dibattito sulla sostenibilità, lo studio si concentra sulle implicazioni della disciplina di tali società rispetto alla posizione dei lavoratori. Questi ultimi sono interessati, infatti, sia come beneficiari o quanto meno stakeholder dell’attività di impresa orientata anche al beneficio comune, che come soggetti direttamente coinvolti nel perseguimento della missione o (potenzialmente) nella sua definizione.
