La "questione di fiducia alla francese" e la prassi italiana: un'Assemblea parlamentare che non vota e una che vota senza decidere

The “French question of confidence” and the italian praxis: a parliamentary Assembly that does not vote and a parliamentary Assembly that votes without deciding. The article analyzes the French constitutional provision which allows the Prime Minister to make the passing of a bill an issue of the Government’s responsibility before the National Assembly with the consequence that the bill shall be considered adopted unless a motion of censure, introduced within the subsequent twenty-four hours, is approved. The aim is to compare the French praxis to the “question of confidence” used by the italian Government, to verify the repercussions of the abuses of these instruments on the parliamentary debate.

L’articolo analizza la previsione costituzionale francese che consente al Primo ministro di impegnare la responsabilità del Governo innanzi all’Assemblea nazionale su una iniziativa di legge, che è considerata approvata a meno che l’Assemblea stessa non approvi una mozione di sfiducia, presentata entro ventiquattro ore, nei confronti del Governo. L’obiettivo è comparare l’istituto francese alla questione di fiducia prevista nell’ordinamento italiano per verificare che tipo di ripercussioni gli abusi di questi strumenti producono sul dibattito parlamentare.
