The ethics of artificial intelligence (AI) requires a profound analysis of basic moral principles and how they can be applied to intelligent technologies. While general principles such as justice and data protection are clear, their application changes depending on the context and the specific use of technology. In the con- text of criminal justice, the deployment of predictive AI gives rise to several sen- sitive issues. The European AI Act identifies certain systems as “high risk”, there- by necessitating the imposition of rigorous control measures to guarantee the in- tegrity of human decision-making processes. The legislation prohibits decisions exclusively made on algorithms, and always requires the involvement of human supervision. Data protection remains a crucial aspect in order to prevent algo- rithmic discrimination and flawed decisions. Anticipatory governance may prove to be an effective approach to navigate the rapid evolution of technology, and to ensure the safeguarding of fundamental rights throughout the entire life cy- cle of AI systems.
L’etica dell’intelligenza artificiale (IA) richiede un’analisi approfondita dei principi morali fondamentali e di come questi possano essere applicati alle tecnologie intelligenti. Sebbene i principi generali, come la giustizia e la protezione dei dati personali, siano riconoscibili, la loro applicazione varia in base al contesto e all’uso specifico della tecnologia. Nel campo della giustizia penale, l’uso di IA predittiva solleva problematiche delicate. L’IA Act europeo riconosce alcuni sistemi come “ad alto rischio”, imponendo misure di controllo stringenti per garantire l’integrità del processo decisionale umano. La legge vieta decisioni basate esclusivamente su algoritmi, richiedendo sempre una revisione umana. La protezione dei dati resta un elemento cruciale per evitare discriminazioni algoritmiche e decisioni errate. Una governance anticipatoria può essere la soluzione per fronteggiare la rapida evoluzione tecnologica, garantendo la tutela dei diritti fondamentali nell’intero ciclo di vita dei sistemi IA.
