There is much debate about the economic treatment of platform workers. Generally, workers are paid for the services performed rather than for the time made available to the company. However, the conditions under which hourly wages can be waived as a means of securing the availability of the labour factor where and when it is needed, do not seem to have been fully explained; nor have suitable guidelines been drawn to orient the legislator, as well as the social partner organisations, in defining a method to establish which internal junctures of the employment relationship are to be taken into account with a view to setting a minimum remuneration level. Adopting an interdisciplinary perspective and a deductive-inductive method, this paper investigates the nexus between the permanent connectivity of workers, the temporal dimension of the employment relationship, and the remuneration practices of platforms, with a view to providing some policy recommendations.
Esiste un ampio dibattito sul trattamento economico dei lavoratori delle piattaforme. Generalmente, i lavoratori sono retribuiti in relazione alle prestazioni eseguite piuttosto che per il tempo trascorso a disposizione dell’impresa. Tuttavia, non sembra che siano state compiutamente spiegate le condizioni che consentono di derogare alla retribuzione oraria quale strumento per assicurarsi la disponibilità del fattore lavoro dove e quando serve, né pare che siano state tracciate delle linee adatte a guidare il legislatore, come anche le organizzazioni delle parti sociali, nell’identificazione dei frangenti interni al rapporto di lavoro da considerare ai fini della determinazione del compenso minimo. Adottando una prospettiva interdisciplinare e un metodo deduttivo-induttivo, il presente scritto indaga il nesso tra la connettività permanente dei lavoratori, la dimensione temporale del rapporto di lavoro e le pratiche retributive delle piattaforme per fornire alcune indicazioni di policy.
