The essay, in light of the coming into force of EU regulation on Artificial Intelligence (AI) and the upcoming final approval of the directive on platform work, deals with the emerging multi-level regulatory framework in the field of algorithmic management of employment relationships. The author, after having pointed out to the particular way AI systems operate and having outlined risks for workers involved in the algorithmic management, examines in detail the most important sources of law at the European level (AI regulation and GDPR, directive on platform work), which are deeply human-centred. The author goes on by reading in an integrated way the most important national pieces of legislation, both the recent ones (chapter V-bis of the legislative decree n. 81 of 2015 on self-employed riders, sect. 1-bis of the legislative decree n. 152 of 1997 on automated decision-making and monitoring systems) and the old ones (sect. 4 and 8 of the Workers’ Statute), while offering an evolutionary interpretation of the last ones. By leveraging the synergy of all levels law sources and, in particular, by enhancing sect. 4 of the Workers’ Statute, the author paves the way for the codetermination of the algorithm: this ambitious perspective, however, requires a radical professional improvement of trade unions officials.
Il saggio, all’indomani dell’entrata in vigore del regolamento UE sull’intelligenza artificiale (IA) e con la direttiva sul lavoro delle piattaforme ormai in dirittura di arrivo, fa il punto sul quadro normativo multilivello che si va componendo nella disciplina della gestione algoritmica dei rapporti di lavoro. L’autrice, dopo aver accennato alle peculiarità modalità con cui operano i sistemi di IA e averne evidenziato i rischi per i lavoratori coinvolti dal management algoritmico, esamina nel dettaglio le principali fonti a livello europeo (regolamenti IA e privacy, direttiva piattaforme), fortemente conformate dal principio antropocentrico. L’autrice procede, quindi, a una lettura integrata con i provvedimenti nazionali più rilevanti in materia, sia recenti (il capo V-bis, d.lgs. n. 81/2015 sui rider autonomi, l’art. 1-bis, d.lgs. n. 152/1997 sui sistemi decisionali e di monitoraggio automatizzati), sia risalenti (gli artt. 4 e 8 dello Statuto dei lavoratori), offrendo di questi ultimi una lettura evolutiva. Proprio facendo leva sulla sinergia tra le fonti di ogni livello e, in particolare, sulla valorizzazione dell’art. 4 dello Statuto dei lavoratori, l’autrice dischiude la prospettiva della cogestione dell’algoritmo, che richiede, tuttavia, un salto di qualità delle risorse professionali a disposizione del sindacato.
